These Terms of Service ("Terms") govern your purchase and use of products and services from Artineer LLC ("we," "us," or "our"), operating under the FunguyLab brand. By placing an order or using our website at funguylab.com, you agree to these Terms.
Mycelian Micro is an educational bio-art STEAM kit that includes hardware components, a low-power laser module, biological materials, and companion software. Products are sold for personal, educational, and research or institutional use — including research and development toward commercial goals. Reproducing, cloning, or commercializing the kit or its underlying technology as a product is not permitted without authorization (see Section 7).
You must be 18 or older to place an order. Kits are intended for learners aged 13 and above and must be used under adult supervision. The kit involves a low-power laser, steps that may use hot water or heat (for example, preparing agar), and living biological cultures. If you purchase for — or permit use by — a minor, you, as the parent, guardian, or supervising adult, are responsible for supervising all use, for ensuring the safety guidelines included with the kit are read and followed, and you assume that supervisory responsibility.
The kit includes non-pathogenic, food-grade Mucor fungal cultures. You agree to handle all biological materials responsibly, keep them away from young children except under adult supervision, and follow the safety guidelines included in the kit. Biological materials have a limited shelf life; we are not responsible for materials that expire due to improper storage or delayed use after delivery.
You are responsible for complying with all laws and regulations of your country, state, and locality regarding the import, possession, use, and disposal of biological materials. We are not responsible for biological materials that are delayed, detained, confiscated, or destroyed by customs, agricultural, plant-health, or quarantine authorities, or for any resulting loss; responsibility for such compliance rests with you as the buyer.
The companion software (control software, neural cellular automaton simulator) is provided under a personal, non-transferable license for use with your kit. You may not redistribute, reverse-engineer, or commercialize the software. Software updates are provided free of charge to kit owners.
All content on funguylab.com and all elements of the Mycelian Micro — including its hardware design, firmware and software, product architecture, methods, and the underlying research implementation — are the property of Artineer LLC or its licensors.
You are free to use this kit in personal, educational, and research or institutional settings — including research, development, and exploration directed toward commercial goals. Anything you create with it is entirely yours, to display or sell freely (see below).
Without our prior written permission, you may not: (a) clone, copy, reproduce, reverse-engineer, or manufacture the kit, its technology, or any of its components; (b) resell, redistribute, rebrand, or distribute the kit — or any derivative or clone of it — as your own product or service; or (c) commercialize our technology at a product, mass-production, or distribution level. To commercialize the technology at that level, contact collab@funguylab.com.
These restrictions concern only our kit, its technology, and its methods — not the artwork you make with it. You retain full ownership of the bio-art you create with your kit — prints, photos, time-lapses, and projects — and are free to display, share, publish, exhibit, or sell your own creations. Creating and sharing your work is encouraged. For commercial licensing of the kit or technology, wholesale, or partnership inquiries, contact collab@funguylab.com.
To the fullest extent permitted by law, Artineer LLC is not liable for any indirect, incidental, or consequential damages arising from your use of our products or website. Our total liability for any claim is limited to the amount you paid for the product giving rise to the claim. Nothing in these Terms limits liability for personal injury caused by our negligence.
Products are provided "as is" without warranty of any kind, express or implied. If your kit arrives with a manufacturing defect, contact us within 14 days of delivery and we will replace the affected components — this is our sole obligation with respect to product quality. Biological outcomes (fungal growth patterns) depend on environmental conditions and are inherently variable; variation is a feature of the science, not a defect.
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law principles, and any disputes will be resolved in the courts of Delaware. Nothing in these Terms removes or limits any mandatory consumer-protection rights you may have under the laws of your country or region of residence that cannot be waived by agreement; where such rights apply, they prevail to the extent required by law.
We may update these Terms from time to time. The updated date at the top of this page reflects any changes. Continued use of our website or products after changes constitutes acceptance of the updated Terms.
